MEMBERSHIP AGREEMENT

This Terms of Use Agreement (hereinafter referred to as the “Agreement”) This Terms of Use Agreement (hereinafter referred to as the “Agreement”) applies to the services provided by the Japanese Society for Intravascular Catheter Research (hereinafter referred to as the “Company”) on this website (hereinafter referred to as the “Services”). The Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions of use of the services provided by the Japan Catheterization Research Institute (hereinafter referred to as the “Institute”) on this website. The following is a summary of the terms and conditions of use of the services provided by the Japanese Society of Intravascular Catheterization Research (“JSRC”) on this website (“Service”). Registered users (hereinafter referred to as “users”) are requested to follow the terms and conditions of this agreement. The registered users (hereinafter referred to as “Users”) are requested to use the Service in accordance with these Terms of Use.

Article 1 (Application)

  1. These Terms of Use shall apply to all relationships related to the use of the Service between the User and the Corporation.
  2. In addition to these Terms of Use, the Corporation may establish various rules and regulations regarding the use of the Service (hereinafter referred to as “Individual Regulations”). These individual provisions, regardless of their names, shall constitute a part of these Terms of Use. Regardless of the name of these Individual Regulations, they shall constitute a part of these Terms of Use.
  3. In the event of any inconsistency between the provisions of these Terms and Conditions and the individual provisions of the preceding Article, the provisions of the individual provisions shall prevail unless otherwise specified in the individual provisions.

Article 2 (Contents of Service)

  1. The corporation will provide the following services
  2. Dissemination of information via a mailing list to which you can subscribe free of charge
  3. Access to free members-only website by registering as a member (given ID and password)
  4. Paid online salon operation
  5. Conducting 3-4 workshops per year with free participation
  6. Establishment of a free research consultation service
  7. The Corporation may change, add, or discontinue the Service with prior notice to the User, and the User agrees to such changes, additions, or discontinuation.

Article 3 (Registration for Use)

  1. The registration for this service is completed when a prospective user agrees to these Terms of Use and applies for registration in the manner prescribed by the Corporation, and the Corporation approves the application.
  2. The Corporation may not approve an application for registration of use if it determines that the applicant has any of the following reasons, and shall not be obligated to disclose the reasons for such denial.
  3. If false information is reported when applying for user registration
  4. If the application is from a person who has violated these Terms and Conditions
  5. Other cases in which the Corporation deems the registration of use to be inappropriate.

Article 4 (Management of User ID and Password)

  1. The User shall properly manage his/her user ID and password for the Service at his/her own responsibility.
  2. Under no circumstances may a user transfer or lend his/her user ID and password to a third party, or share them with a third party. When a user logs in with the same combination of user ID and password as the registered information, the Corporation will consider the use of the service to be by the user who has registered the user ID.
  3. The Corporation shall not be liable for any damage caused by the use of user IDs and passwords by third parties, except in the case of willful misconduct or gross negligence on the part of the Corporation.

Article 5 (Usage Fees and Payment Methods)

  1. As compensation for the paid portion of the Service, the User shall pay the usage fee separately determined by the Corporation and indicated on the Website in the manner designated by the Corporation.
  2. If the User is late in paying the usage fee, the User shall pay a late fee at the rate of 14.6% per annum.

Article 6 (Prohibited Matters)

In using the Service, the User shall not engage in any of the following acts

  1. Acts that violate laws and regulations or public order and morals
  2. Conduct related to criminal activity
  3. Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in this service, including the contents of this service.
  4. Any act that destroys or interferes with the functionality of the server or network of the Corporation, other Users, or any third party.
  5. Commercial use of information obtained through this service
  6. Actions that may interfere with the operation of our services
  7. Unauthorized access or attempts to gain unauthorized access
  8. Collecting or accumulating personal information about other users.
  9. Use of the Service for any unauthorized purpose.
  10. Acts that cause disadvantage, damage, or discomfort to other users of this service or other third parties
  11. Impersonating another user
  12. Advertising, publicity, solicitation, or business activities on the Service that are not authorized by the Corporation
  13. Aiming to meet someone of the opposite sex whom you are not acquainted with
  14. Acts of providing benefits directly or indirectly to antisocial forces in relation to the services of the Corporation

Other acts that the Corporation deems inappropriate

Article 7 (Suspension of Provision of the Service, etc.)

  1. The Corporation may suspend or discontinue the Service, in whole or in part, without prior notice to the User, for any of the following reasons
  2. When performing maintenance inspections or updating of computer systems related to this service
  3. (iii) When it becomes difficult to provide this service due to force majeure such as earthquake, lightning, fire, power outage, or natural disasters.
  4. In the event of computer or communication line outage due to accident
  5. In any other cases where the Corporation deems it difficult to provide the Service.
  6. The Corporation shall not be liable for any disadvantage or damage incurred by users or third parties as a result of the suspension or interruption of the provision of the Service.

Article 8 (Restriction of Use and Cancellation of Registration)

  1. The Corporation may restrict a User's use of all or part of the Service or terminate the User's registration as a User without prior notice if the User falls into any of the following cases
  2. Violation of any of the provisions of these Terms and Conditions
  3. When it is found that there is a false fact in the registration information
  4. In the event of default in payment of fees and other obligations
  5. If you do not respond to our communications for a certain period of time
  6. When there has been no use of this service for a certain period of time since the last use
  7. In any other cases where the Corporation deems the use of the Service to be inappropriate.
  8. The Corporation shall not be liable for any damages incurred by the User as a result of any action taken by the Corporation pursuant to this Article.

Article 9 (Withdrawal from Membership)

The User may withdraw from the Service by following the withdrawal procedure specified by the Corporation.

Article 10 (Disclaimer of Warranty and Disclaimer of Liability)

  1. The Corporation does not warrant, expressly or impliedly, that the Service will be free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.). (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors and bugs, and infringement of rights).
  2. The Corporation shall not be liable for any damages incurred by the User arising from the Service, except in cases of intentional or gross negligence on the part of the Corporation. However, this disclaimer shall not apply if the contract between the Corporation and the User for the Service (including this Agreement) is a consumer contract as defined in the Consumer Contract Act.   3. Even in the case of the proviso of the preceding paragraph, the Corporation shall not be liable for damages arising out of special circumstances (including cases in which the Corporation or the User foresaw or could have foreseen the occurrence of the damages) among damages incurred by the User due to the Corporation's negligence (excluding gross negligence), default or tort. Article 11 (Modification of Terms of Use)

  1. The Corporation reserves the right to modify these Terms and Conditions without requiring individual user consent in the following cases
  2. When changes to these Terms are in the general interest of users.
  3. When the modification of these Terms of Use is not contrary to the purpose of the Service Usage Agreement and is reasonable in light of the necessity of the modification, the reasonableness of the modified contents, and other circumstances pertaining to the modification.
  4. In amending these Terms and Conditions in accordance with the preceding paragraph, the Corporation will notify the User in advance of the amendment, the contents of the amended Terms and Conditions, and the effective date of the amendment.

Article 12 (Handling of Personal Information)


The Corporation will appropriately handle personal information obtained through the use of this service in accordance with the “Privacy Policy” of the Corporation.

Article 13 (Notice or Communication)

Notification or communication between a user and the corporation shall be made in the manner prescribed by the corporation. Unless a user notifies us of a change in his/her contact information in accordance with a method separately determined by us, we will assume that the contact information currently registered with us is valid and send notices or communications to such contact information, which will be deemed to have reached the user at the time they are sent.

Article 14 (Prohibition of Assignment of Rights and Obligations)

The User may not assign its position under the User Agreement or its rights or obligations under these Terms of Use to any third party or offer them as security without the prior written consent of the Corporation.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute regarding the Service, the court having jurisdiction over the location of the head office of the Corporation shall have exclusive jurisdiction.
